Class action lawsuits against companies for deceptive marketing are on the rise these days and Hershey’s lawsuit is the latest one in this category. A number of people have moved to court to file a lawsuit against over the design of their Reese’s candies. The people who filed these lawsuits alleged that the displayed on a number of Reece’s peanut butter cups were misleading to some of their customers.
The plaintiffs in the lawsuit argued that the information on Reese’s candies was way misleading to many customers. The plaintiff further claimed that the peanut butter image on the Reece peanut butter wrap looked carved out artistic which convinced many buyers to buy the candy. However, when the chocolate were unwrapped from their packaging materials, the actual products were found to be blank.
The lawsuit plaintiffs argued that the deceptive marketing from Hershey’s where they used false images to get as many as people to buy their products. According to the plaintiff in the lawsuit, this action by Hershey’s was deliberate which only sought to increase the number of people buying Hershey’s products.
Such marketing practices are unethical and thrive on exploiting customers through deceptive marketing according to the plaintiff. The Hershey’s lawsuit plaintiff claim that a good number of clients who bought Hershey products would not have bought them had the not used deceptive false marketing. This claim gives strength to the argument that had been put forward earlier on of Hershey using false marketing to increase their sales volumes.
The Hershey Lawsuit Settlement Demands
There are four known plaintiffs in the Hershey lawsuit and many more are likely to join in the coming days. Even though the plaintiff have filed these lawsuits, they are yet to make any settlement agreements regarding how much they need in settlement or how much the affected customers should be compensated.
Considering that this case is likely to turn into a class action lawsuit, there is a good chance the plaintiff will make a figure known regarding how much they need the affected customer to be paid. At this point, the plaintiffs are yet to specify how much they are looking for in the lawsuit and when they want the settlement paid and in which manner.
Hershey Response to the Lawsuit Against it
Hershey has responded to the Hershey lawsuit by denying it altogether. In its well thought out response, Hershey claimed that the candy design on their packaging wrappers was artistic and did not need to be identical to the actual design itself. Hershey is yet to make further comments on the lawsuit.
This lawsuit formed the basis of a wide online speculation especially on social media. This case being the latest class action lawsuit filed against a company for false marketing and deception has also drawn great scrutiny to itself from the public. It is still unclear at this point whether the plaintiff will prevail in the lawsuit or the defendant will prevail in refuting the allegations levelled against it.
